i thought B was correct simply because capital investment is a more succinct manner of saying investing capital. i don't know what GMAT likes though between the two.

I do believe D is wrong because the "with" at the end changes the meaning of the stem. the 0 demand for new construction is not specific to these specific existing structures.

if B is wrong, then A has gotta be the OA.

I am sorry I wasn't clearer earlier.. In the context of the sentence.. by current situation I mean the current situation in the market (or any place) where the federal incentives apply..

Despite means with intention in the face of an obstacle.
Even though is in spite, which is more adequate.
This takes out A and E.

"with no demand" is akward.
Leaves C.

(B) is correct and "there" is an expletive that introduces the noun smoothly ... read a grammar book to know more about expletives.
