IMO A

That is always used to refer the phrase! ... so that is not an option ! So u r down and B

B u have more than one reason to eliminate !! usage of is ( prep) and determining is not appropriate .. we are looking for infinitive

I would say C

THAT is parallel with the first THAT..."agreed that...and that..."

And WHETHER fits better than THAT

I also got it down to C or D. IMO C was the winner. Whether for me was the better fit in this sentence.
