The meaning issue is that arguing that is not followed by some kind of argument, as it is in the following examples.
arguing that the judge should act
arguing that the company is suffering
When you are arguing something, you are saying something. So there has to be something you are saying.
The market is going to go up.
In B and D, arguing that is not followed by a statement, an argument. Rather it is followed by the judge act, which is not a statement. You can request that the judge act. You wouldn't argue that the judge act.
Also, in B, the client does not clearly convey what client is being discussed or that the client is the lawyers' client, and damages of an economic nature is awkward and wordy.
Also, in D, them can only refer to the lawyers, and thus using them conveys that the lawyers themselves are suffering economic damages.
E is correct because arguing that is followed by a statement, immediate action should be taken, their client clearly defines what client is being discussed and economic damages is clear and concise.
