Litigation explosion

Some commentators complain that a “litigation explosion” in the past decade has led to unreasonably high costs for U.S. businesses by encouraging more product liability suits against manufacturers. However, these complaints are based mainly on myth. Statistics show that the number of successful product liability suits has remained almost the same, and the average sum awarded in damages has grown no faster than the inflation rate.
Which of the following, if true, would most weaken the argument above?

IMO
B .. because even though average payout has not increased substantially, the max payout would have occured within past decade

To me A seems very relevant because it talks about "unsuccessful suits" adding to the cost which is related to the argument about successful suits discussed in the sentence

B is wrong because it says "the average cost has remained the same". Which means that if there have been large awards in the past two years then there also have been some really small awards.

B is out of scope when it states a typical case.
While the argument presents a general situation of litigation.

A is the choice because it cracks the conclusion" the statistics of successful suit" is same for past two years,
A: unsuccessful suit skyrocketed.
