Since needs present perfect tense so A, B and E are gone.

Between C and D

I will go with D, since it we need to another present perfect tense

c. has heard cases in which lawyers debated what constituted segregation.

d. has heard cases in which lawyers debated what has constituted

We need present perfect tense with Since.

IMO C

c. has heard cases in which lawyers debated what constituted segregation.

d. has heard cases in which lawyers debated what has constituted segregation

Hearing is still done , therefore has heard and lawyers debated in the past, therefore constituted.

This is means , action started in the past and effects are still present

( Institute was created in 1897 and still existent..so present perfect)

iamcste leave piyush alone!! :)

Piyush,

Since always marks a time in the past which continues to the present. And this calls the usage of present perfect tense.

You can get the feeling better from the link above and solve the little quiz to hard wire this concept:

I agree with Piyush because when I break it down, "has heard" and is ongoing action (that is carried over from the past- like lawyers debated) where the issue being debated is that of segregation. The issue is being debated and not the causes of the issue.

Hello!

Please, let me take my chances and try to explain the reason for C:

in D we have Present Perfect tense (has heard) in the 1st part of the sentence and also the same tense (has constituted) in the 2nd part thus we can "drop" (read "skip") HAS in the 2nd part => C is correct according to GMAT.

d. has heard cases in which lawyers debated what has constituted segregation.
Since makes it clear we need to go with present perfect. So left with option C and D
IMO C
the usage has constituted shows the verb/its effect is still true.
But in option C-> it clearly states the topic of debate: What constituted segregation.
