The site asks prospective candidates to take TOEFL if their degrees have been from universities where English was NOT the sole language of instruction. How can I prove this and waive off the language tests from my application?

Typically if your transcripts are in English, that indicates that the school's language of instruction is English. If you have any doubts, you can contact the Harvard admissions office to see what they say (email or telephone).
