I selected D because it conveyed proper meaning i.e. henry may/may not marry anne.

i dont see where would comes into picture...if you are refering to choice E, it is incorrect mainly beacuse idiom is ' in order to'.....'in order that ' is incorrect.

What the OG explanation means is that the correct alternative in this case should make use of "could" and not "would"..

Use of "could" indicates that after the annulment the King would be free to marry Anne Boleyn if he chose to..

Use of "would" on the other hand would have indicated that the annulment of his marriage to Catherine would eventually automatically lead to his marriage with Anne Boleyn..This would distort of the meaning of the sentence which is only trying to say that the King wanted the annulment so that he could marry Catherine.
