IMO E.

Subjunctive mood is proper only in C/E.

A - mandate that X, Y are allowed - wrong
B - mandate that X would be - wrong
D - mandating that - modifies the entire preceding clause and gives awkward meaning.

Between C/E
C - which refers to the four freedoms and again the right of free movement seems redundant.

E is more clear and concise.
Getting defeated is just a temporary notion, giving it up is what makes it permanent.

What helps us identify this question as a Subjunctive question as well as identify the mistake is the following Stop Sign:propose/recommend/require/request/insist/suggest/mandate/ask/demand thatWhenever you come across this Stop Sign, make sure that the following verb is in its base form.

Kartik is right. The words act as sign posts when a sentence is in the subjunctive mood.

Just observe carefully, there are two clauses in the sentence. The second sentence has the verb mandate which is in its base form and also the subjunctive is most suited in the above sentence as it is kind of an order given by the EU or the government hence the use of "BE".

Hope this helps for recognising the subjunctive.......
