I have another problem

At a recent conference, the Transit Authority has
stated that the provisions in the Clean Air Act
fail to promote mass transit as an alternative to
private transpor tation.

(A) has stated that the provisions in the Clean
Air Act fail
(B) stated that the provisions of the Clean Air
Act fail
(C) has stated that the provisions of the Clean
Air Act will fail
(D) stated that the provisions in the Clean Air
Act are a failure
(E) has stated the provisions in the Clean Air
Act failed

B seems to be the correct answer but i hve issues with the tense of fail

but the correct idiom is not only..but also and here u have not only..but..also.
Is it correct idiomatically?

Have a look at it this way:
"the provisions fail to promote mass transit" is more concise than "the provisions are a failure to promote mass transit."

Using "failed", the analysis of the effectiveness of the Clean Air Act would have a specific end date which occurred prior to the date that the conference was held.

Using "fail", as written, the implication is that this analysis of the Clean Air Act has been analyzed for some duration of time, but that this analysis is ongoing - that is, the analysis has not been concluded.

if we use have failed it would mean that the provision has failed in the past and it still cotinues to do so?
