Question : use of "so as to"

Congress is debating a bill requiring certain employers provide workers with unpaid leave so as to care for sick or newbom children.

(B) to provide workers with unpaid leave so as to

(D) to provide workers with unpaid leave so that they can

Here B seems to be absolutely correct. But its wrong. y?

the deal is that "so as to" can never be used together
the idiom is ....so X as to Y
