would go for E

A. subject-verb error. uses "was" for reporter and his assistant.

B. the use of "the fact" makes it too wordy

C. the use of "their" after despite is unnecessary

D. the use of "the fact" makes it too wordy

E. correct IMO, the opening participal phrase correctly modifies the reporter and his assistant, placed as close as possible. the use of "were" is proper with the plural subject.

IMO B...

In rest of the options, "him" has ambiguous reference....it can refer to either "the attorney" or "his assistant"...

The question does not seem to be from a reliable source.B is the best choice ,however, it has the phrase 'Despite the Fact', which is non standard in Gmat.

I agree with typhoonguy in terms of the answer choice and my reservations about it.

yes, agreed E does look bad because of the use of "him" for the attorney and his assitant. B looks better inspite of "despite the fact"

thanks for pointing out AragornII and typhoonguywlblwu

yes you are right PAB2706, B seems better inspite of being wordy.

fell into the wordiness trap and missed out the "him" standing for attorney and the assistant

thanks for pointing out !
