IMO D.

the only thing to look for here is a parallel structure.

suspected the police "of having"... and.."of using" is correct.

Eliminate A,B and C.

E is passive and thus WORDY.

D is correct.

This question is about Parallelism.

The lawyer charged that she suspected the police of having illegally taped A and then used the info....

First Question is : Who used the information? --> Police.
So Parallelism must come in context to police. There are 2 parallelism possibility here -

The lawyer charged that she suspected the police of having illegally taped A and then the police of having illegally used the info....

Vs

The lawyer charged that she suspected the police of having illegally taped A and then the police of using the info....

I think by meaning of sentence, the police obtained the information illegally, but use of the information was not illegal. So A,B,C are out. Left with D and E --> you can easily eliminate E because wordy ("such", "as they", "would be supportive of").

One more thing - Police is plural though it sounds singular.

With 3-2 Split in the answer choices, I could understand this is "parallelism" error SC.
Now the challenge is to identify the correct parallel set.

1) Parallelism identifier here is AND

.... charged that she suspected the police of having illegally taped her.... AND then used the information obtained to find evidence

Generally, we start from 2nd part to ensure that both the sets are parallel. We need to find "What" is parallel to "the information obtained to find evidence"

I suppose, you would agree that its "She suspected - police used the information obtained to find evidence" !! Hence, both the parts are parallel with the idea that "she suspected the police".... bla bla bla....

1st part - She suspected the police of having illegally taped her .....
2nd part - She suspected the police of using the information they had obtained....

2) Word suggested demands for subjunctive statement. Hence, would is necessary

A - supporting is participle which describes the whole clause before it instead of describing the evidence.
B - Lack of parallelism And also a bit wordy
C - Lack of parallelism
E - a bit wordy - "would be supportive of"...[/list]
