B - the damaging of - awkward
C - 'compensating state governments' is preferred over 'giving state governments compensation'
D - damage of is not || to the injury to.
E - the giving of compensation to state governments - looks so awkward.

IMO A.
Getting defeated is just a temporary notion, giving it up is what makes it permanent.
