As/That confusion! How to identify?

Congress is debating a bill requiring certain employers provide workers with unpaid leave so as to care for sick or newbom children.

(A) provide workers with unpaid leave so as to
(B) to provide workers with unpaid leave so as to
(C) provide workers with unpaid leave in order that they
(D) to provide workers with unpaid leave so that they can
(E) provide workers with unpaid leave and

I think D is the best available choice. but D also has an ambiguous pronoun 'they'

(A) provide workers with unpaid leave so as to: Refers to employer as noun while second part should refer to worker in line with the meaning
(B) to provide workers with unpaid leave so as to: Same as A
(C) provide workers with unpaid leave in order that they
(D) to provide workers with unpaid leave so that they can
(E) provide workers with unpaid leave and : Same as A

What is the reason for your doubt. Is it the doubt between C & D only? let me know your thoughts. I want to know how you perceive the issue.

If you consider the meaning of B, it gives the impression that the govt is doing something, so as to...do something.

While in D, they clearly refer to Workers.....and its worker who want to care for sick and newborns.


Hope this clears. And tell me OD as well.....if it is B, I shall have to commit suicide and you know why:)
