Judge Bonham denied a motion "to allow members of the jury to go home at the end of each day instead of to confine them to "a hotel.

This is an example of using a directive verb, deny. So we use the root form of the verb confine.
confinement is a noun and not a verb

Therefore E is correct

Correct answer should be E. 'be confined' is correct. Option D incorrectly uses confinement.
