Hi GMATguruNY, I killed A because of "by failing".As I understand the action "fail" is done by attorney. Do I understand wrong in this way?

Hi Mitch, may I ask why choice D is wrong?
My consideration is to choose a better parallelism from A and D. For me, "By doing instead of by doing is very clear."
