Can I request anybody replying to this post not just give their answer choice but explain why they chose it as that would be more helpful than just the correct answer
I dont know what to look for in this sentence....
Judge Bonham denied a motion to allow members of the jury to go home at the end of each day instead of to confine them to a hotel.
(A) to allow members of the jury to go home at the end of each day instead of to confine them to
(B) that would have allowed members of the jury to go home at the end of each day instead of confined to
(C) under which members of the jury are allowed to go home at the end of each day instead of confining them in
(D) that would allow members of the jury to go home at the end of each day rather than confinement in
(E) to allow members of the jury to go home at the end of each day rather than be confined to

It will be E. As rather than is more suitable. Reason:
I'll use Instead of when sentence shows choices i.e. in place of A take B . It can be written as A instead of B

SInce you have motion between denied and xyz there it has to be motion to.
it could have been that had the sentence been written as denied that.
Now you have A n E. E is better constructed.

"instead of" must have a noun following.
"rather than" can have anything.
when in doubt go with "rather than!"

But case by case, in E, is the sentence parallel? Shouldn't it be "allow sb to ..rather than to be .."?

OG says - "The construction x instead of y, when x and y are infinitives, is clumsy. The reason, parallelism.
A wrong for reason mentioned by suman.
Judge denied a motion requires either that or infinitive, C out.
Of B and D that use that, but B uses perfect present which is unecessary. D has parallelism issues.
E correctly uses parallelism.

everybody is missing a Main point here.
The answer is straight away E. [ dpn't care about 'instead of' vs rather than' ]
E is correct because of the usage of 'be confined to'
Actually the second part need to be written in passive voice.
(Because the members are not going to confine themselves)
Except E, every choice is written in active voice.
