idioms---usage of "fault"

Hi,

I have a question about the usage of "fault", the following sentence is a wrong one:

It is the fault of the criminals who broke the law


Is it correct that I use " to" instead of "who"? The new sentence will be like this:

It is the fault of the criminals to break the law. Is this a right one?
